US Election: Elon Musk Wins Lawsuit Over PAC's $1M Voter Giveaway

Elon Musk’s $1 million voter giveaway will proceed after a Pennsylvania state judge declined to immediately halt the initiative. The decision allows Musk’s Political Action Committee (PAC), America PAC, to continue distributing funds to registered voters just days before the November 5 U.S. presidential election.

Philadelphia District Attorney Larry Krasner had sought a court injunction, alleging that the giveaway constitutes an illegal lottery designed to influence voters. However, Judge Angelo Foglietta placed the case on hold, allowing Musk’s efforts to continue while a federal court considers taking up the case.

During a hearing in Pennsylvania, Judge Foglietta decided not to move forward with Krasner’s lawsuit until it is clear whether federal courts will handle the matter. The case involves complex questions of election law and free speech, which Elon Musk’s attorneys argue fall under federal jurisdiction. Krasner’s office, however, maintains that the lawsuit addresses state law issues, specifically consumer protection laws.

Krasner’s complaint, filed on October 28, argues that the giveaway, organized through Elon Musk’s America PAC, violates state laws by operating as an unregulated lottery. The PAC has been offering $1 million checks to randomly selected participants who sign a petition supporting free speech and gun rights.

Prosecutor John Summers, representing Krasner, told reporters he plans to push for the case’s return to state court, contending that the alleged violations are a state matter.
